Property Preparation 

  1. The client is responsible for ensuring the property is "camera-ready" before the scheduled appointment window begins. This includes completing all cleaning and furniture staging in advance. 

  2. We recommend sharing our “Pre-Shoot Checklist” with your clients.

  3. If the photographer arrives and the property is not ready, it will be photographed "as is."

  4. We value your feedback in selecting the best angles to showcase the property. If you'd like to provide input, please meet with the photographer at the start of the appointment. 

  5. In the absence of specific instructions, the photographer will use their professional judgment and expertise to capture the property in its best light.

Order Details and Accuracy  

  1. The client is responsible for providing accurate and complete information when placing an order. We reserve the right to correct any inaccuracies and adjust the pricing accordingly (e.g., if the property is listed as 1,200 square feet but is actually 2,400 square feet).

  2. Our pricing is based on a single residential dwelling. For commercial properties or multi-unit buildings, please contact us via phone number or email to receive a customised quote.

Reschedule/Cancellation Policy   

  1. InVision Media & Marketing does not charge cancellation or rescheduling fees, even if we arrive at the shoot and it is not ready. We know that things happen, and our goal is to be as close to part of your team as possible.

  2. If an appointment cannot be completed due to weather conditions (e.g., drone flights are not possible due to rain or wind, or heavy rain prevents exterior photography), it will be rescheduled in coordination with the agent or business owner.

Payment Terms   

  1. You will receive an invoice once all media has been delivered, with payment due upon receipt. A late fee of £25 per month will be applied to any unpaid balances after 15 days.

  2. If your account has an outstanding balance over 45 days, InVision Media & Marketing will temporarily freeze all assets and suspend new orders until the balance is settled.

  3. Accounts with unpaid balances exceeding 90 days will be referred to a collections agency.

Service Area Coverage   

  1. We provide complimentary coverage across the entire island.

Hostings   

  1. InVision Media & Marketing guarantees media hosting for one year from the appointment date, except for 3D-tours and floor-plans. 3D-tour media will be hosted until the property is sold, up to a maximum of six months. After the hosting period ends, it is the user's responsibility to arrange permanent storage for the media.

Grant of Rights   

  1. You grant InVision Media & Marketing and its partners a non-exclusive, worldwide license to use, reproduce, display, and distribute the content ("Work") created under these terms in any current or future media. The Work includes photos, videos, 3D content, floor plans, graphics, and other related materials, as well as any derivatives.

  2. InVision Media & Marketing retains ownership and copyright of the Work and may use it for portfolios, promotions, contests, exhibitions, or display purposes. The company may also transfer, license, or share the Work with its commercial partners.

  3. You do not own the Work and may not sell, license, modify, or create derivatives from it without prior written consent from InVision Media & Marketing.

Usage Rights    

  1. InVision Media & Marketing grants you a license to use the images from the Work for marketing the property, promoting your real estate business, listings, brokerage, or related businesses. This license ("Your License") is non-exclusive, non-transferable, and allows use across all territories and media, including your websites, for an unlimited time.

  2. You may also authorise third-party websites (e.g., MLS or real estate listing portals) to display the content solely to advertise the property while it is actively listed for sale. This authorisation automatically ends when the property is no longer for sale or when the listing agreement with the property owner ends, whichever comes first.

Releases, Licenses & Authorisations   

  1. By hiring InVision Media & Marketing, you confirm that you are authorised to do so and have obtained all necessary permissions ("Clearances") to grant the rights outlined in these Terms and Conditions. This includes permission from the property owner and any other rights holders, such as those related to intellectual property or the property's design.

  2. You also confirm that the property owner and occupants have waived any privacy expectations regarding the images captured and used as specified in this agreement.

  3. You agree to indemnify and protect InVision Media & Marketing from any claims, costs, or legal fees arising from your failure to obtain the required Clearances or exceeding the permissions you secured.

Indemnification/Hold Harmless   

You agree to protect and indemnify InVision Media & Marketing, its team, contractors, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

  1. Your breach of any warranties, representations, or certifications in this agreement.

  2. Your negligent or intentional actions (or those of your employees, contractors, property owner, or guests) related to the performance of this agreement or the use of the Work created.
